February 23, 2024 – Attorney General Michelle Henry announces a lawsuit against Davis Communications Internet, Inc. and its owner, David Davis, alleging that it operated as an internet provider but actually resold them Internet services purchased from legitimate providers.
According to the Attorney General’s Office lawsuit, the defendants subscribed to commercial internet plans and then advertised as providers and resold connections while specifically targeting consumers in rural areas of York County where internet options were limited.
The lawsuit seeks to enjoin Davis Communications and David Davis from selling Internet services in Pennsylvania, as well as to prohibit consumer damages, civil penalties and disgorgement of profits.
“This sham business allegedly targets consumers who are disconnected from traditional internet networks and in dire need of reliable internet connections,” said Attorney General Henry. “My office will always oppose businesses that target vulnerable Pennsylvanians.”
According to the lawsuit, Davis Communications advertises itself as a legitimate internet provider offering services such as “LTE high-speed internet” and “truly unlimited service.”
The lawsuit also alleges that the defendants misrepresented the causes of Internet service outages and outages and failed to provide refunds after consumers were automatically billed. Instead, defendants allegedly ignored requests for refunds or baselessly accused consumers of engaging in “data abuse,” a vague and confusing term.
Pennsylvanians are advised to be aware of any other companies that may be misrepresenting themselves as legitimate Internet service providers. Some steps consumers can take to protect themselves include checking the company on the Federal Communications Commission (FCC) or Pennsylvania Public Utilities Commission (PUC) websites.
